Reinstatement vs new operating authority

Reinstatement usually concerns previously granted authority held by the same legal entity. A new authority application may be appropriate for a new entity or a different operating need. Review the company history and current restrictions before deciding; a new application does not remove existing compliance obligations.

When reinstatement fits

If the existing entity holds revoked authority and the cause can be corrected, review reinstatement first. Confirm the legal business identity, USDOT number, authority history and reason for revocation. Preserve the company’s existing records and resolve the requirements associated with them.

When a new application needs review

A new legal entity, a different authority type or an application that was never granted may need a different filing path. Review ownership and entity changes carefully rather than assuming the old authority can simply be reused. The operating-authority hub explains new applications.

Compare costs by purpose

The $80 FMCSA reinstatement payment relates to restoring eligible existing authority. New application fees serve a different purpose. Private preparation fees are separate from agency charges, and insurance or corrective costs can apply to either path.

Make the decision from the record

Collect the current registration record, operating-authority history and any notices. Identify the legal entity that will conduct the operations. If the correct path is unclear, resolve that question with FMCSA before submitting duplicate applications or scheduling regulated operations.
