Out-of-service orders: violations and penalties

An out-of-service order restricts the operations described in the order. Continuing those operations can lead to civil penalties and driver or carrier consequences. Read the order, stop the prohibited activity and follow the stated corrective process before resuming.

Identify the kind of order

A roadside driver or vehicle order differs from a carrier-level federal out-of-service order. Identify who is subject to the restriction, which operations it covers and the corrective conditions. Do not assume that a registration update resolves a safety or enforcement order.

Penalties depend on the violation

Consequences depend on the order, the conduct, prior violations and current regulations. Civil penalty amounts can be adjusted over time. Review the actual notice and current FMCSA guidance rather than treating a historical dollar amount as the amount that applies to your case.

Preserve the evidence of correction

Save the order, inspection reports, maintenance or compliance records, correspondence and any agency confirmation. Assign responsibility for each corrective step and keep dispatch informed about restrictions. Documentation supports review; it does not replace the required approval or release.

How an order changes reinstatement

An authority reinstatement request is not a substitute for resolving the underlying out-of-service order. Confirm the required correction with FMCSA and distinguish USDOT status from operating-authority status. If an order involves safety findings or a disputed violation, seek advice appropriate to that specific proceeding.

Questions

Does submitting a reinstatement request authorize operations?

No. Confirm that the relevant restriction is resolved and the required authority status is active before operating.
