BOC-3 Lapse
Also known as: Missing BOC-3, Cancelled Process-Agent Designation

Definition
A BOC-3 lapse is a revocation cause: the carrier’s BOC-3 process-agent designation is cancelled or was never properly filed. 49 CFR Part 366 requires every interstate motor carrier, broker and freight forwarder to keep a process agent designated in each state where it operates. If a process-agent company drops the carrier, often for non-payment, and no replacement BOC-3 is filed, FMCSA can revoke the operating authority. Curing it means getting a new BOC-3 on file through a process-agent company, then requesting reinstatement. FMCSA reviews the request and decides on it once the record shows the designation in place.
