49 CFR Part 366
Also known as: 49 CFR §366, Designation of Process Agents Rule
By Korey Sharp-Paar · Reviewed by the Fast Trucking Compliance team
Definition
49 CFR Part 366 is the federal regulation that requires every interstate motor carrier, broker and freight forwarder to designate a process agent in every state where it operates, so that lawsuits, subpoenas and other legal papers can be served there. The designation is filed with FMCSA on Form BOC-3, which is how the rule is put into practice. An active designation under Part 366 is a precondition for FMCSA granting operating authority, and motor carriers cannot designate themselves; most use a blanket process-agent service that covers all 50 states and the District of Columbia.
