Also known as: 49 CFR §386, FMCSA Enforcement Rules, Rules of Practice for FMCSA Proceedings

Definition
49 CFR Part 386 is the federal regulation governing FMCSA enforcement proceedings. It sets the rules of practice for civil-penalty cases and for the orders that suspend or revoke operating authority, and it is the legal basis behind an involuntary revocation for an unpaid penalty. Civil penalties assessed under Part 386 can block reinstatement until they are paid or otherwise resolved. Operating in interstate commerce while authority is revoked is prohibited, and FMCSA can assess civil penalties for it under the same rules, so a revoked carrier should wait until FMCSA shows the authority as active again before accepting loads.
