Compliance FAQ

What causes most DOT reinstatements?

Common causes are an insurance lapse (the insurer cancels the BMC-91/91X or BMC-84/85 filing and no replacement is filed), a cancelled BOC-3 process-agent designation, and unpaid civil penalties. Adverse safety ratings are another cause; they take longer to resolve because recovery depends on an FMCSA review.

Why does it matter?

Insurance lapse: when the BMC-91/91X (carriers) or BMC-84/85 (brokers) filing is cancelled and no replacement is on file when the cancellation takes effect, FMCSA revokes the authority. Common reasons include unpaid premiums, a renewal the insurer didn't file, or switching insurers without an overlap.

BOC-3 cancellation: happens when a process-agent provider stops representing the carrier (for example, the provider closes or the service is cancelled) and no new BOC-3 is filed. The fix is a new BOC-3 on file with FMCSA.

Unpaid civil penalties: a carrier that doesn't pay a final civil penalty, or keep to an agreed payment plan, can be prohibited from operating and have its registration suspended or revoked (49 CFR 386.83).

A missed MCS-150 leads to USDOT deactivation (49 CFR 390.19T(b)(4)), fixed by filing the update. FMCSA has temporarily suspended enforcement and USDOT inactivation for biennial updates due on or after June 1, 2026; the update is still required. The biennial filing schedule is keyed to the last two digits of the USDOT number and is easy to miss when the person who handled FMCSA filings has left.

Adverse safety rating: a Conditional rating does not by itself revoke authority, but an Unsatisfactory rating that becomes final leads to an out-of-service order and revocation (49 CFR 385.13). Recovery depends on corrective action and FMCSA review, so it is the longest path back.

Start your reinstatement request

We prepare your reinstatement request; it is submitted to FMCSA by you or a filer you authorize. FMCSA charges an $80 fee to reinstate revoked MC operating authority (49 CFR 360.3T). For MC reinstatement, our $220 service fee and the $80 FMCSA fee are itemized as two separate amounts before you pay ($300 total). DOT out-of-service reinstatement is a $200 service fee with no FMCSA fee.
