Compliance FAQ

Do I need a fresh BOC-3 for reinstatement?

It depends on the cause of revocation. If the original BOC-3 lapsed (caused or contributed to revocation), a fresh BOC-3 is required as part of reinstatement. If the original BOC-3 is still on file with FMCSA and the registered process-agent provider remains in good standing, the existing designation may be sufficient. Some carriers file a fresh BOC-3 anyway to be sure the designation is current.

Why does it matter?

The process-agent designation required by 49 CFR Part 366 is part of what active operating authority needs. For reinstatement, FMCSA checks that the designation is currently met - either by the original BOC-3 still being on file with a current registered provider, or by a fresh BOC-3 filed during the reinstatement process.

For revocations where the original BOC-3 lapsed (the provider lost its FMCSA blanket process-agent registration, or the carrier's legal name changed and the prior designation no longer matches), a fresh BOC-3 is required. It is filed with FMCSA by a registered process-agent provider; you can confirm it in FMCSA's Motus public search (by USDOT number or company name).

For revocations where the original BOC-3 is still valid (for example, a revocation caused by an insurance lapse with the BOC-3 unaffected), the carrier can rely on the existing BOC-3. Some carriers file a fresh one anyway (a BOC-3 through Fast Trucking Compliance is $75 one-time) to remove any doubt that the designation is current.

For time-sensitive reinstatements, line up the BOC-3 filing in parallel with the insurer's BMC-91/91X filing so neither waits on the other.

Start your reinstatement request

We prepare your reinstatement request; it is submitted to FMCSA by you or a filer you authorize. FMCSA charges an $80 fee to reinstate revoked MC operating authority (49 CFR 360.3T). For MC reinstatement, our $220 service fee and the $80 FMCSA fee are itemized as two separate amounts before you pay ($300 total). DOT out-of-service reinstatement is a $200 service fee with no FMCSA fee.
