MC reinstatement after revocation

Reviewed by Korey Sharp-Paar · Updated

Your MC was revoked - for lapsed insurance, failed audit, or enforcement action. Your FMCSA reinstatement request is prepared for you for a $220 service fee plus the $80 FMCSA reinstatement fee ($300 total, itemized as two separate amounts). Submitted to FMCSA by you or a filer you authorize. Login.gov account recovery help costs nothing extra. FMCSA controls how long its review takes under 49 CFR Part 365. A missed MCS-150 leads to USDOT deactivation (49 CFR 390.19T(b)(4)), fixed by filing the update. FMCSA has temporarily suspended enforcement and USDOT inactivation for biennial updates due on or after June 1, 2026; the update is still required.

How MC revocation differs from suspension

FMCSA-side enforcement starts with a suspension (typically lapsed-insurance) - a soft hold pending correction of the underlying deficiency. If the deficiency isn't corrected within FMCSA's suspension window (typically 30 days), the suspension converts to a revocation. Revocation is the terminating event - the MC is removed from active status and the carrier cannot legally accept interstate freight under that authority.

Reinstatement is how an MC returns to active status. The carrier corrects the underlying deficiency, the reinstatement request is submitted, and FMCSA reviews the request once the cause is cured and decides whether to reinstate; FMCSA controls that decision and how long its review takes. Revoked-MC reinstatement questions

What gets an MC revoked?

The most common revocation triggers are: lapsed BMC-91 insurance (insurer notifies FMCSA, suspension converts to revocation if not corrected within window), failed §385 new-entrant safety audit (uncorrected deficiencies after 60-day plan), unsatisfactory §385.13 safety rating after a compliance review, repeat HOS or hazmat-incident violations triggering enforcement action, and FMCSA fraud findings on the application or filings.

How long does reinstatement take?

Your reinstatement request can be submitted to FMCSA once the cause is cured; FMCSA controls how long its review takes. For audit-failure cases, the carrier first has to demonstrate substantive correction of the §391 / §382 / §395 / §396 deficiencies - which takes weeks of documentation work - before a reinstatement request can succeed.

Does reinstatement give me back the same MC number?

In most cases yes. FMCSA treats reinstatement as restoring an existing registration rather than issuing a new one - same MC, same USDOT, same SAFER history. The exception is when FMCSA won't restore the old authority; in that case the carrier files a fresh OP-1 and gets a new MC number.
