Compliance FAQ

Can I reinstate authority after 3 years of inactivity?

Possibly. Whether an older authority can still be reinstated is FMCSA's decision for that specific record. If FMCSA won't reinstate it, a new OP-1 application issues a new MC number. A new application goes through FMCSA's new-applicant review, including the 10-day protest period after the FMCSA Register notice (49 CFR 365.203T); FMCSA controls the timing.

Why does it matter?

FMCSA decides case by case whether an older authority can be reinstated or whether a new application is needed, based on the carrier's records.

The practical test: cure the underlying cause and submit the reinstatement request with the $80 fee (49 CFR §360.3T(f)(52)). FMCSA's response tells you whether the old authority can be reinstated. You can check the current authority status in FMCSA's Motus public search (by USDOT number or company name).

Before submitting, make sure the USDOT number itself is current: a missed MCS-150 leads to USDOT deactivation (49 CFR 390.19T(b)(4)), fixed by filing the update. FMCSA has temporarily suspended enforcement and USDOT inactivation for biennial updates due on or after June 1, 2026; the update is still required.

If FMCSA won't reinstate the old authority, the path is a new OP-1 application with the $300 FMCSA fee. It issues a new MC number. A new application goes through FMCSA's new-applicant review, including the 10-day protest period after the FMCSA Register notice (49 CFR 365.203T); FMCSA controls the timing. The old MC number stays in FMCSA's history.

Start your reinstatement request

We prepare your reinstatement request; it is submitted to FMCSA by you or a filer you authorize. FMCSA charges an $80 fee to reinstate revoked MC operating authority (49 CFR 360.3T). For MC reinstatement, our $220 service fee and the $80 FMCSA fee are itemized as two separate amounts before you pay ($300 total). DOT out-of-service reinstatement is a $200 service fee with no FMCSA fee.
