Compliance FAQ

When do I need reinstatement vs a new MC application?

Reinstatement when FMCSA will still reinstate the existing authority; a new MC application when it won't. Reinstatement keeps the original MC number, USDOT number, and history. A new application gets a new MC number. A new application goes through FMCSA's new-applicant review, including the 10-day protest period after the FMCSA Register notice (49 CFR 365.203T); FMCSA controls the timing.

Why does it matter?

Reinstatement is preferred when available because it preserves the carrier's existing relationships - broker contracts, customer agreements, banking relationships - that may be tied to the original MC number. The carrier's SAFER safety history (inspections, crash data, BASIC measures) carries forward, which is good if the history is positive but neutral-to-negative if the history is poor.

A new MC application is required when FMCSA won't reinstate the original. The OP-1 issues a new MC number, and established relationships need contract updates to the new number.

The practical test is to cure the cause and submit the reinstatement; FMCSA's response tells you whether the original authority can be reinstated. Fast Trucking Compliance's MC authority reinstatement price is itemized as two separate amounts: $220 service fee + $80 FMCSA fee = $300 total. If FMCSA won't reinstate, the path forward is an OP-1 application; Fast Trucking Compliance's new-authority price is itemized as $199 service fee + $300 FMCSA fee.

For carriers with both paths open, the decision usually turns on the value of the existing history. Clean history: reinstatement preserves it. Poor history: a new application starts a new MC number, but FMCSA reviews new applications for links to previously registered carriers, so it is not a sure route to a clean slate.

We prepare your reinstatement request; it is submitted to FMCSA by you or a filer you authorize. FMCSA charges an $80 fee to reinstate revoked MC operating authority (49 CFR 360.3T). For MC reinstatement, our $220 service fee and the $80 FMCSA fee are itemized as two separate amounts before you pay ($300 total).
