What a BOC-3 is and who needs it

Form BOC-3, the designation of process agents, names a person in each state who can accept legal papers for your company. FMCSA requires for-hire motor carriers, brokers and freight forwarders to have one on file before it grants operating authority (49 CFR Part 366). Carriers that run in more than one state usually use a blanket process agent company, which has agents in every state; FMCSA lists those companies on its process agents page.

Only operating in one state? See do I need a BOC-3 if I only operate in one state. For how the BOC-3 differs from your other first-year filings, read BOC-3 vs UCR and process agent vs registered agent.

What to check before you pick a BOC-3 service

Four things separate one BOC-3 service from another. None of them is speed of filing, and FMCSA’s fee is $0 everywhere.

Blanket coverage in every state

Interstate carriers need an agent in each state where they operate. A blanket filing lists one process agent company that has agents in all 50 states and D.C., so one BOC-3 covers every state you run.

One-time or annual fee

FMCSA does not charge for the BOC-3 and does not require it to be renewed each year. Some services still bill annually for the agent relationship. Read the fee model on the vendor page before you pay.

Who files it

A motor carrier cannot file its own BOC-3. The process agent or blanket agent company files it with FMCSA for you. Brokers and freight forwarders that operate no commercial motor vehicles may self-file.

Re-file policy

A new BOC-3 is needed if you change process agent companies, if your agent company stops operating, or after some reinstatements. Ask what a later re-file costs; most vendor pages do not say.

Single-state or blanket? Single-state vs blanket process agent walks through the difference.

Can you do it yourself?

You cannot self-file a BOC-3 as a motor carrier. The filing has to come from a process agent or a blanket process agent company (49 CFR Part 366), and FMCSA publishes a list of blanket companies on its process agents page. FMCSA charges $0 for the designation, so what you pay any service is its own fee. Brokers and freight forwarders that operate no commercial motor vehicles may file their own BOC-3.

Common BOC-3 buying questions

Do I need a BOC-3 for new MC authority?

Yes. For-hire motor carriers, brokers and freight forwarders must have a BOC-3 designation of process agents on file before FMCSA grants operating authority (49 CFR Part 366).

Can I file my own BOC-3?

Not as a motor carrier. A process agent or blanket process agent company files the BOC-3 for you. Brokers and freight forwarders that operate no commercial motor vehicles may self-file.

Should I use a blanket BOC-3 or a single-state process agent?

For interstate carriers, blanket coverage is the practical choice: you need an agent in every state where you operate, and a blanket filing covers all of them in one BOC-3. A single-state agent covers only the state it names.

Does a BOC-3 have to be renewed every year?

FMCSA does not require an annual BOC-3 renewal. Some services charge an annual fee anyway, so check whether a vendor’s price is one-time or recurring.

How much does a BOC-3 cost?

FMCSA charges $0 for the BOC-3. Services set their own fees. Fast Trucking Compliance charges a flat $75 one-time fee; the comparison table on this page lists each vendor’s published price with its source and check date.

How do I order a BOC-3 from Fast Trucking Compliance?
