What changed
FMCSA L&I refreshed the process-agent verification system on March 28, 2026 in line with 49 CFR Part 366. The update replaces the legacy validation rules with a real-time registry check that confirms each named agent maintains a physical address and active business registration in the listed state.
Existing BOC-3 designations on file before March 28 continue to be valid - no carrier needs to refile because of the rule update. New BOC-3 submissions, including any name changes or agent switches, must clear the new validation. Filings from process-agent services that have not registered every state's underlying agent will be rejected on submission.
Who this affects
New for-hire interstate carriers filing their initial BOC-3 should confirm their selected service has full 50-state coverage with agent verification. Reputable services have already pre-registered; lower-cost alternatives that aggregate via subcontract chains may face validation issues.
Brokers and freight forwarders are subject to the same rule - their BOC-3 filings (always required for interstate operating authority) face the same registry check.
How to verify your existing BOC-3
Check your USDOT record on FMCSA SAFER - the BOC-3 status line shows the filing service and date. If it shows "Active" with a recent-enough date, you're fine. If it shows "Pending" or "Rejected," contact your service immediately for re-submission under the updated rules.
